The regular meeting of the Medford Planning Commission was called to order at 5:30 p.m. in the Council Chambers on the above date with the following members and staff in attendance:

20. Consent Calendar/Written Communications.
20.1 LDS-09-089 Final Order for a request to revise three conditions of approval for the approved tentative plat for Innsbruck Ridge, a 60-lot subdivision on approximately 24.36 acres within the Vista Pointe Planned Unit Development, located on the east side of Vista Pointe Drive within the SFR-4/PD (Single Family Residential – 4 dwellings per acre/Planned Unit Development Overlay) zoning district. The subject conditions are related to on-street parking/approved alternate method of construction, street trees, and pedestrian paths. (Innsbruck LLC, Applicant; CSA Planning Ltd., Agent).
20.2 LDP-14-063/E-14-090 Final Orders for a request to create two parcels and an Exception to allow an 89 foot lot depth in lieu of the required 90 foot depth on 0.64 acre located the east side of Merriman Road, approximately 50 feet south of the easterly terminus of Mace Road in the SFR-6 (Single Family Residential, 6 dwelling units per gross acre) zoning district (2772 Merriman Road). (Legacy Development, LLC, Applicant; Mark Snyder, Agent).

50. Public Hearing.
50.1 LDP-14-086 Consideration of tentative plat review for one lot partition of a 5.73 acre site located on the west side of Interstate 5 and north of Barnett Avenue within a Regional Commercial (CR) zoning district. (Oregon Department of Transportation, Applicant; Stephan L. Barott, Agent).
Chair Zarosinski inquired whether any Commissioners have a conflict of interest or ex parte communication they would like to disclose. None were disclosed.
Chair Zarosinski inquired whether anyone in attendance wishes to question the Commission as to conflicts of interest or ex-parte contacts. None were disclosed.
Desmond McGeough, Planner II, read the land division criteria and gave a staff report.
Commissioner McFadden stated that he is surprised that this application does not have a zoning component to the partition. He does not think the Interstate has a particular zoning classification. How did staff get to assigning it a zone. Mr. McGeough replied that he did not look back at the history but in terms of where zoning districts usually go, they typically go out to the center line of a street. In this circumstance in went out to the midpoint of Interstate 5 and Barnett Avenue. The area to the south is zoned Regional Commercial.
The public hearing was opened and the following testimony was given.
a. Stephan L. Barott, 1446 St. Andrew Way, Medford, Oregon, 97504. Mr. Barott reported that he is a professional land surveyor. He is the agent for Oregon Department of Transportation who could not make it down from Salem this evening due to weather and other restrictions. The Oregon Department of Transportation wants to dispose of some unused vacant land. The only avenue they have to do that is with a one lot partition. It is unusual. They normally do not do this. There is no development going on. The entire content of this application is to create a legal lot which would be taxable.
Alex Georgevitch, Transportation Manager, stated that for clarification to the applicant that Exhibit B requires future City of Medford drainage easements. Mr. Georgevitch wanted to make sure that it is understood that the easements are recorded prior to final plat.
Commissioner McFadden asked Mr. Barott if the future easement is a final deal at the time of recording that the Medford Water Commission, Avista and City of Medford Public Works easements will be created at the time of recording. Mr. Barott replied that there is a cross access easement to the parcels to the west. They have the drainage for the City, Medford Water Commission and Avista that they are working on those. They planned on having them completed before tonight but that did not happen. They are aware of them.
Chair Zarosinski asked staff that in the motion does it need to be stated prior to final plat or is the staff report clear enough? Mr. Georgevitch requested that prior to final plat be stated in the motion.
The public hearing was closed.
Motion: Adopt the Findings as recommended by staff and direct staff to prepare the Final Order for approval of LDP-14-086 per the Staff Report dated October 16, 2014, including Exhibits A through M and that all easements shown on the tentative plat and the cross access easement are recorded prior to final plat.

60. Report of the Site Plan and Architectural Commission.
60.1 Commissioner Miranda reported that the Site Plan and Architectural Commission met on October 17, 2014. The only item that came before the Commission was a continuance request for AC-14-088 that was consideration of plans for the construction of a 2,475 square foot Del Taco restaurant located at the southwest corner of East Stewart Avenue and East Barnett Road on 0.73 acres. The continuance was granted.
70. Report of the Joint Transportation Subcommittee.
70.1 Commissioner Christie reported that the Joint Transportation Subcommittee’s scheduled meeting was canceled due to a lack of agenda items.
80. Report of the Planning Department.
80.1 Kelly Akin, Principal Planner, stated that there will be a Planning Commission study session on Monday, October 27, 2014.
There is business scheduled for Thursday, November 13, 2014 with four items scheduled and Thursday, December 11, 2014 there are three items scheduled.
Today City Council had a study session on the Urban Growth Boundary Amendment. City Council directed staff to bring the Internal Study Areas forward to them before the External Study Areas.
On November 6, 2014, City Council will hear the electronic sign code revisions.
The City is still working on the Strategic Plan update. Staff sent out an email to the Commissioner’s a couple of weeks ago with the online survey.
