The Medford City Council Study Session was called to order at 12:00 p.m. in the Medford Room of Medford City Hall on the above date with the following members and staff present:
Mayor Gary Wheeler; Councilmembers Clay Bearnson, Daniel Bunn, Chris Corcoran, Dick Gordon, Kevin Stine, Michael Zarosinski
Councilmembers Tim Jackle and Eli Matthews were absent.
City Manager Brian Sjothun, Deputy City Manager Bill Hoke, City Attorney Lori Cooper, Fire Chief Brian Fish, Deputy City Recorder Winnie Shepard
Lawsuits – Employee Coverage
City Attorney Lori Cooper distributed a proposed resolution. She noted Attorney Robert Franz recommended issuing the resolution to indemnify and defend our police officers regarding damages.
  • If there were previous cases, Council will need to determine coverage
  • The lawsuit was filed against the City and the two officers individually
    • Currently, they are covered under the City’s attorneys
  • The purpose of the resolution is to ensure coverage of officers
  • Ms. Cooper will check with Mr. Franz to determine if “officers acted within policy” should be added to the resolution; however, it is unknown what details may be discovered during trial
  • Should come before Council October 6, 2016 or October 20, 2016
Medford Rural Fire Protection District 2 Contract
Ms. Cooper noted she had reviewed and agreed with the contract.
Fire Chief Brian Fish introduced Bob Sheets, President Medford Rural Fire District #2.  Chief Fish provided the history of Medford’s partnership with District #2 and noted the City and the District currently have an IGA, but there are changes in the new agreement. 
  • Biggest change is with collection rates
    • Due to prepayment discounts, nonpayment or other reasons, the District’s collection rate averages around 94% of the fees levied annually
    • In the proposed contract, the District will pay the City 80%, of the fees levied
    • The remaining 20% will be used for apparatus, equipment and training
    • Outlined the equipment fleet
    • The proposed contract is for 10 years, with a 10 year extension
Councilmember Stine and Mr. Fish discussed the 20% spent for apparatus, equipment and training.  Councilmember Stine questioned whether the City could take more than 80% and place it in reserve.  Mr. Fish explained that a specific number was in the contract, we would be limited to that number. 
Council and Mr. Fish discussed how the IGA benefited the District and the City.
Council and Mr. Fish discussed the apparatus funding and that the District purchases the equipment for the City’s use.  Councilmember Stine suggested increasing our payment to 85% and adding the 5% to the City’s apparatus fund.  Mr. Fish noted the 20% includes fleet training as well. 
The District’s legal counsel is reviewing the contract.  Mr. Fish would like to bring the IGA to Council for approval in October.
The meeting adjourned to an Executive Session at 12:33 p.m.
